The law was promulgated in the Official Journal and came into effect on Friday, July 21, 2023. Growing cannabis plants is now possible, but well-regulated, limited, and the seeds must be properly labeled. Everyone can now grow their own cannabis plants almost like they grow tomatoes. Legally, each household can grow four cannabis plants at home for personal use, while there is no limit on the number of tomatoes. Seeds, however, will be available in stores, carefully labeled, according to the requirements of the Grand-Ducal regulation published by the Ministry of Health on Friday, July 21, 2023.<\/strong> According to the Ministry of Justice: “Seeds can be obtained everywhere; every store can purchase and resell them, and it is also possible to buy them online.” This resolves the issue, which remained unclear even in the commission’s report, although the report did acknowledge the judicial authorities’ criticisms regarding the seeds in question.<\/p>\n\n\n\n

<\/h2>\n\n\n\n

Furthermore, the public prosecutor’s office reiterates in its opinion that the importation of cannabis seeds remains prohibited and notes that the draft law is silent on how consumers can obtain them. <\/strong> However, the draft law does not include any regulations on seeds; it only addresses cannabis cultivation and makes no mention of the possession, acquisition, transport, or sale of seeds, which are also considered illegal under existing regulations. Once it is authorized to cultivate cannabis plants,<\/strong> It is, of course, permitted to purchase seeds in stores or online, provided that the labeling clearly indicates the producer, the number of seeds, and a health warning.<\/p>\n\n\n\n

All essential information regarding seed labels is defined in the Grand-Ducal Regulation. In CBD shops and stores, all necessary measures have been taken by those who have closely followed this development. According to a shopkeeper in Remich: “The law has been passed; nothing now prevents us from selling cannabis seeds.”<\/strong>However, another shopkeeper living in Mondorf has not yet had time to review the law and is still unaware that the sale of seeds has been legal since last Friday. According to her: “It’s great; everyone has been ordering online for a long time anyway, so now they can buy them in stores.” It is important to remember that only adults may legally cultivate up to four plants, and this must be done from seeds. The plants must not be visible from public spaces or consumed outside the home.<\/strong> Anyone who dares to break the law will risk a fine of between \u20ac25 and \u20ac500.<\/p>\n\n\n\n

Finally, anyone who possesses, transports, or acquires for their own use a quantity of recreational cannabis or cannabis derivatives exceeding three grams risks up to six months in prison and a fine of up to \u20ac2,500.<\/strong> <\/p>\n\n\n\n
