Luxembourg: Growing your own cannabis, a reality

The law was published in the Official Journal and came into force on Friday, July 21, 2023. The cultivation of cannabis plants is now possible, well regulated, limited, and the seeds are properly labeled.

Now everyone will be able to grow their cannabis plants almost like their tomato plants

Now, anyone can grow their own cannabis plants almost as easily as tomatoes. Legally, each household can grow four cannabis plants at home for personal use, whereas there is no limit on the number of tomatoes that can be grown.

Compared to seeds, they will be found in stores, carefully labeled, according to the requirements of the Grand-Ducal published by the Ministry of Health on Friday, July 21, 2023.

According to the Ministry of Justice : "Seeds can be obtained everywhere, every store can get them and resell them, and it is also possible to buy them online."

This settles the issue which was unclear even in the commission's report, which nevertheless noted the criticisms of the judicial authorities concerning the seeds in question.

Furthermore, the prosecutor's office notes in its opinion that the importation of cannabis seeds remains prohibited and observes that the draft law remains silent on the question of how consumers will be able to obtain the seeds.

However, the bill does not provide for regulations on seeds; it only deals with the cultivation of cannabis, but does not mention the possession, acquisition, transport or sale of seeds, which are also considered illegal under existing regulations.

From the moment it is permitted to cultivate cannabis plants, it is obviously permitted to obtain seeds in stores, or online, provided that the labeling must mention the producer, the number of seeds and a health warning.

All essential information relating to seed labels is determined in the Grand-Ducal Regulation.

In CBD shops and stores , all necessary measures have been taken by those who have been closely following the news. According to a shopkeeper in Remich: "The law has been passed; nothing now prevents us from selling cannabis seeds."

However, another shopkeeper living in Mondorf hasn't yet had time to review the law and is still unaware that selling seeds has been legal since last Friday. According to her, "It's great; everyone's been ordering online for ages anyway, so now they can buy them in stores.".

It is important to remember that only adults may legally cultivate up to four plants, and this must be done from seed. The plants must not be visible from public spaces nor consumed outside the home.

Anyone who dares to break the law will risk a fine of between 25 and 500 euros. Furthermore, anyone who possesses, transports, or acquires for their own use a quantity of recreational cannabis or cannabis derivatives exceeding three grams risks up to six months in prison and a fine of up to 2,500 euros.
