This important measure has been welcomed, as it is seen as a way to protect consumers and support hemp producers, while encouraging a regulated and thriving market.
Why was the Hemp Access and Consumer Safety Act proposed?
CBD, a substance derived from hemp, has become an increasingly popular product in recent decades, with thousands of consumers across the country having access to a variety of products containing this molecule.
However, current regulations do not provide clear guidelines on its safety and labeling, which is causing concern among consumers and manufacturers.
To address this situation, a bipartisan group of legislators introduced the Hemp Access and Consumer Safety Act. This law aims to regulate CBD, a hemp derivative, under the supervision of the FDA.
Since the Farm Bill of 2018 legalized the production and sale of hemp, hemp-based CBD products have flooded the market. Despite this, the lack of clear FDA regulations has left consumers and manufacturers uncertain about the safety of these products.
Current legislation regarding food, medicines, and cosmetics prohibits the introduction of new food ingredients but allows for exemptions. To date, hemp-derived CBD has never been exempted, leaving manufacturers in a regulatory gray area.
To address the lack of regulation, many legislators introduced the Hemp Access and Consumer Safety Act.
This proposal aims to allow CBD products to be used legally in dietary supplements, food and beverages, in accordance with existing federal food, drug and cosmetic regulations.
This would give the FDA the power to regulate hemp-derived CBD in the same way as other approved food ingredients.
The law received significant support from various political and industry actors.
For example, Senators Ron Wyden, Rand Paul and Jeff Merkley, as well as Representative Earl Blumenauer have all expressed their belief that this regulation is essential for consumer protection and for supporting hemp producers.
Similarly, Jonathan Miller, general counsel for the American roundtable on hemp, welcomed this measure as a way to create a regulated market while ensuring consumer safety.
