- Irony Surrounding a Ban
- Facebook banned our advertising account because we used #CBD in some social media posts. We neither advertised nor sold CBD beverages on Instagram, and therefore, the closure of our account seems arbitrary and wrong. Since advertising on our main channel became impossible, we decided to take a chance and be creative on a more traditional platform. An advertisement, an awareness campaign, a silence that’s finally broken!
We have the CBD drink ready, but for regulatory reasons, we can’t sell it in Finland or other Nordic countries. With this campaign, we wanted to spark discussion and raise awareness about CBD and legal cannabis in general.
Using CBD and hemp as wellness products and using cannabis recreationally are two completely different things. That’s what we’re trying to emphasize.
“We believe we need to campaign to normalize CBD in the eyes of Nordic consumers.” Is common-sense legislation on the horizon?
It’s difficult to navigate when the rules differ from country to country. The EU single market should treat all businesses and consumers equally. This isn’t the case with CBD.
CBD is considered a prescription drug in Finland, contrary to the EU principle of the free movement of goods, which applies to CBD, as clearly stated by the ECJ. There’s a risk that the Finnish Medicines Agency will maintain CBD’s medical status even if the EU classifies it as food. There should be an open and coordinated effort to harmonize CBD legislation across the EU. There’s a risk that even after the approval of new CBD-based foods, Member States will refuse to enforce them, leaving businesses and consumers to navigate the completely confusing mix of national laws within the single market. We need a predictable path to clear rules for businesses and greater protection for consumers. CBD and legislation in France: a major controversy.
